Terms of Service

These Terms of Service ("Terms") govern your access to and use of etrenzik.com (the "Site"), the Etrenzik smart home mobile application (the "App"), and the products, services, and content we provide (collectively, the "Services"), offered by Etrenzik ("Etrenzik," "we," "us," or "our").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Services or create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

You agree to provide accurate, current, and complete information and to keep it updated.

2. Use of the Services

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Services, our systems, or any connected device or network.
• Reverse engineer, decompile, or attempt to derive source code from the App, except to the extent this restriction is prohibited by law.
• Reproduce, resell, or commercially exploit any part of the Services without our written permission.
• Upload or transmit malware, or use automated means to scrape or overload the Services.

3. The Smart Home App and Connected Devices

The App allows you to pair, configure, monitor, and control compatible Wi-Fi smart home devices. You acknowledge and agree that:

• Use of the App requires a compatible device, an active internet connection, and a supported mobile operating system. Performance depends on your network, your devices, and third-party services outside our control.
• The App relies on the Tuya IoT platform for device connectivity and cloud control. Interruption, degradation, or discontinuation of that platform may affect App functionality.
• The App is not a life-safety, security, or emergency-response system. It must not be relied upon where failure could result in injury, death, or property damage. Do not use the App as the sole means of monitoring or controlling any safety-critical function.
• Notifications and alerts may be delayed, undelivered, or inaccurate due to network, device, or platform conditions.
• Devices must be installed and used in accordance with manufacturer instructions and applicable electrical and building codes.

4. Products, Quotes, Orders, and Installation

Product listings, specifications, availability, and pricing on the Site are provided for informational purposes and may change without notice. Quotes are valid only for the period stated and are subject to confirmation, stock availability, and final measurement or site conditions.

Energy-savings figures, payback periods, rebate estimates, and ROI calculations presented on the Site are estimates only, based on assumptions that may not reflect your actual conditions. Actual results vary by facility, usage, utility rates, incentive programs, and installation. Nothing on the Site is a guarantee of savings or rebate eligibility.

Utility rebate and incentive programs are administered by third parties and are subject to their rules, funding, and approval. We may assist with applications, but we do not guarantee approval or payment.

Installation and electrical work is performed by licensed contractors. Scope, schedule, warranty, and pricing for such work are governed by the separate written agreement or proposal for that project, which controls in the event of a conflict with these Terms.

5. Warranties

Product warranties, where offered, are provided by the applicable manufacturer or as expressly stated in your order or project agreement. Warranty terms, duration, and remedies are set out in those documents.

EXCEPT AS EXPRESSLY STATED, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ETRENZIK AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE APPLICABLE PRODUCT OR SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

7. Indemnification

You agree to indemnify and hold harmless Etrenzik and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.

8. Intellectual Property

The Services, including all content, design, text, graphics, logos, and software, are owned by Etrenzik or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose. All rights not expressly granted are reserved.

9. Third-Party Links and Services

The Services may link to or interoperate with third-party sites, platforms, and services. We do not control and are not responsible for their content, policies, or practices. Your use of third-party services is governed by their terms.

10. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for conduct that violates these Terms or is otherwise harmful to us or others. You may stop using the Services and delete your account at any time. Sections intended to survive termination — including warranty disclaimers, limitation of liability, indemnification, and governing law — will survive.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Georgia, United States, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or the Services will be brought exclusively in the state or federal courts located in Georgia, and you consent to their jurisdiction and venue.

12. Changes to These Terms

We may modify these Terms at any time. We will update the "Last updated" date above and, where required, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

13. Miscellaneous

If any provision of these Terms is held unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right. These Terms, together with any applicable order or project agreement and our Privacy Policy, constitute the entire agreement between you and Etrenzik regarding the Services.
